The Idea of Human Rights pdf/epub/kindle/txt ebooks

Inspired by a 1988 trip to El Salvador, Michael J. Perry's new book is a personal and scholarly exploration of the idea of human rights. Perry is one of our nation's leading authorities on the relation of morality, including religious morality, to politics and law. He seeks, in this book, to disentangle the complex idea of human rights by way of four probing and interrelated essays. * The initial essay, which is animated by Perry's skepticism about the capacity of any secular morality to offer a coherent account of the idea of human rights, suggests that the first part of the idea of human rights--the premise that every human being is |sacred| or |inviolable|--is inescapably religious. * Responding to recent criticism of |rights talk|, Perry explicates, in his second essay, the meaning and value of talk about human rights. * In his third essay, Perry asks a fundamental question about human rights: Are they universal? In addressing this question, he disaggregates and criticizes several different varieties of |moral relativism| and then considers the implications of these different relativist positions for claims about human rights. * Perry turns to another fundamental question about human rights in his final essay: Are they absolute? He concludes that even if no human rights, understood as moral rights, are absolute or unconditional, some human rights, understood as international legal rights, are--and indeed, should be--absolute. In the introduction, Perry writes: |Of all the influential--indeed, formative--moral ideas to take center stage in the twentieth century, like democracy and socialism, the idea of human rights (which, again, in one form or another, is an old idea) is, for many, the most difficult. It is the most difficult in the sense that it is, for many, the hardest of the great moral ideas to integrate, the hardest to square, with the reigning intellectual assumptions of the age, especially what Bernard Williams has called 'Nietzsche's thought': 'There is not only no God, but no metaphysical order of any kind....' For those who accept 'Nietzsche's thought', can the idea of human rights possibly be more than a kind of aesthetic preference? In a culture in which it was widely believed that there is no God or metaphysical order of any kind, on what basis, if any, could the idea of human rights long survive?| The Idea of Human Rights: Four Inquiries will appeal to students of many disciplines, including (but not limited to) law, philosophy, religion, and politics.

Today it is usually not long before a problem gets expressed as a human rights issue. Indeed, human rights law continues to gain increasing attention internationally, and must move quickly in order to keep up with a social world that changes so rapidly. This Very Short Introduction, in its second edition, brings the issue of human rights up to date, considering the current controversies surrounding the movement. Discussing torture and arbitrary detention in the context of counter terrorism, Andrew Clapham also considers new challenges to human rights in the context of privacy, equality and the right to health. Looking at the philosophical justification for rights, the historical origins of human rights and how they are formed in law, Clapham explains what our human rights actually are, what they might be, and where the human rights movement is heading. ABOUT THE SERIES: The Very Short Introductions series from Oxford University Press contains hundreds of titles in almost every subject area. These pocket-sized books are the perfect way to get ahead in a new subject quickly. Our expert authors combine facts, analysis, perspective, new ideas, and enthusiasm to make interesting and challenging topics highly readable.

With unique scholarly analysis and practical discussion, this book provides a comprehensive introduction to the relationship between environmental protection and human rights being formalized into law in many legal systems. This book instructs on environmental techniques and procedures that assist in the protection of human rights. The text provides cogent guidance on a growing international jurisprudence on the promotion and protection of human rights in relation to the environment that has been developed by international and regional human rights bodies and tribunals. It explores a rich body of case law that continues to develop within states on the environmental dimension of the rights to life, to health, and to public participation and access to information. Five compelling contemporary case studies are included that implicate human rights and the environment, ranging from large dam projects to the creation of a new human right to a clean environment.

Human Rights in the Digital Age pdf/epub/kindle/txt ebooks
By:Mathias Klang,Andrew Murray
Published on 2005 by Psychology Press

The digital age began in 1939 with the construction of the first digital computer. In the sixty-five years that have followed, the influence of digitisation on our everyday lives has grown steadily and today digital technology has a greater influence on our lives than at any time since its development. This book examines the role played by digital technology in both the exercise and suppression of human rights. The global digital environment has allowed us to reinterpret the concept of universal human rights. Discourse on human rights need no longer be limited by national or cultural boundaries and individuals have the ability to create new forms in which to exercise their rights or even to bypass national limitations to rights. The defence of such rights is meanwhile under constant assault by the newfound ability of states to both suppress and control individual rights through the application of these same digital technologies. This book gathers together an international group of experts working within this rapidly developing area of law and technology and focuses their attantion on the specific interaction between human rights and digital technology. This is the first work to explore the challenges brought about by digital technology to fundamental freedoms such as privacy, freedom of expression, access, assembly and dignity. It is essential reading for anyone who fears digital technology will lead to the 'Big Brother' state.

This book provides the first comprehensive assessment of the contribution of the United Nations to the human rights situation of the Bahá ís in Iran. It does this by examining the theoretical, legal, institutional and political dimensions of this issue in detail. The situation of the Bahá í community in Iran between 1979 and 2002 provides a particularly good test case for the international community due to its clarity. By giving attention to a singular case within a discrete time frame, this book is able to effectively examine the impact of UN human rights protection. Attention is given in this study to the clash between religion and human rights, the protection of freedom of religion or belief in international law, the workings of UN human rights charter-based and treaty bodies and their various mechanisms, and recommendations for the resolution of the Bahá í human rights situation in Iran.

The securitization that accompanied many national responses after 11 September 2001, along with the shortfalls of neo-liberalism, created waves of opposition to the growth of the human rights regime. By chronicling the continuing contest over the reach, range, and regime of rights, Contracting Human Rights analyses the way forward in an era of many challenges. Through an examination of both global and local challenges to human rights, including loopholes, backlash, accountability, and new opportunities to move forward, the expert contributors analyse trends across multiple-issue areas. These include; international institutions, humanitarian action, censorship and communications, discrimination, human trafficking, counter-terrorism, corporate social responsibility and civil society and social movements. The topical chapters also provide a comprehensive review of the widening citizenship gaps in human rights coverage for refugees, women's rights in patriarchal societies, and civil liberties in chronic conflict. This timely study will be invaluable reading for academics, upper-level undergraduates, and those studying graduate courses relating to international relations, human rights, and global governance.

This is a second, thoroughly revised and expanded edition of a book that has four clear objectives: to provide a concise account and analysis of international human rights and humanitarian law standards relevant to policing; to set out arguments for compliance with those standards; to show how they may be met in two key areas of policing, interviewing suspects of crime, and policing in times of armed conflict, disturbance and tension; and to make practical recommendations on the management of police agencies. Good practice on interviewing suspects and on policing conflict is included because they are areas of policing where human rights are most at risk. Good management practice is included because intelligent management by enlightened leaders is necessary to secure effective, lawful and humane policing.

Human Rights and the Negotiation of American Power pdf/epub/kindle/txt ebooks
By:Glenn Mitoma
Published on 2013-04-01 by University of Pennsylvania Press

The American attitude toward human rights is deemed inconsistent, even hypocritical: while the United States is characterized (or self-characterized) as a global leader in promoting human rights, the nation has consistently restrained broader interpretations of human rights and held international enforcement mechanisms at arm's length. Human Rights and the Negotiation of American Power examines the causes, consequences, and tensions of America's growth as the leading world power after World War II alongside the flowering of the human rights movement. Through careful archival research, Glenn Mitoma reveals how the U.S. government, key civil society groups, Cold War politics, and specific individuals contributed to America's emergence as an ambivalent yet central player in establishing an international rights ethic. Mitoma focuses on the work of three American civil society organizations: the Commission to Study the Organization of Peace, the National Association for the Advancement of Colored People, and the American Bar Association—and their influence on U.S. human rights policy from the late 1930s through the 1950s. He demonstrates that the burgeoning transnational language of human rights provided two prominent United Nations diplomats and charter members of the Commission on Human Rights—Charles Malik and Carlos Romulo—with fresh and essential opportunities for influencing the position of the United States, most particularly with respect to developing nations. Looking at the critical contributions made by these two men, Mitoma uncovers the unique causes, tensions, and consequences of American exceptionalism.

The &“disappearance&” and torture of many people during the worst days of the authoritarian regimes that ruled many Latin American countries in the 1970s have been well documented and widely condemned as abuses of human rights. Less well known is what has become of the movements for human rights once democratic governments were restored in these countries. In this book, Michelle Bonner reveals how the defense of human rights continues today, taking Argentina as her primary example (with comparison to Chile in the final chapter). Bonner shows that the role of women&—viewed as protectors of the family&—is key to understanding how human rights movements have evolved. Moreover, the continuity of the &“historical frames&” used to legitimate their activity is an essential element in the success of their efforts, even while the claimed abuse has changed from the political repression undertaken by the dictators&’ minions to the economic hardships created by market inequities resulting from neoliberal policies. Based on extensive field research and providing a long historical view extending from colonial times to the present, this study compares the activities of the ten most prominent human rights organizations in Argentina and assesses the responses of both state and society.

Forty years ago the European Convention for the Protection of Human Rights & Fundamental Freedoms came into force. It was born of the shared conviction that breaches of the most elementary human rights, such as had been experienced in the 1930s & '40s, should never be allowed to occur again. The Convention & the control bodies responsible for ensuring the observance of the engagements undertaken by the contracting States have had a profound influence on democratic European society in the latter half of this century, & have had repercussions outside Europe too; indeed the European system of human rights protection has served as a model or basic reference text for other regional systems. The European System for the Protection of Human Rights is a unique collection of essays by some of the most outstanding scholars & practitioners in the field of European Human Rights. Its aim is not only to sum up forty years of European experience in the collective endeavour to protect human rights, but above all to stimulate critical thinking about that experience & to review whether the Convention sytem as it stands is still fitted to meet the needs of European society in the coming millenium.

Challenges for Human Rights pdf/epub/kindle/txt ebooks

Nowadays we are fortunate enough to be experiencing a boom in human rights - an enormous increase of their importance in the international sphere at all levels (political, economic, social, legal and moral). For the first time the condition of the individual as |citizen,| and not just as |subject,| has gained importance. Individuals, and not only states, have now become the subjects of international law, as a result of the boom in humanitarian law and international criminal law. However, although there have been many battles won and goals met concerning human rights, the war against injustice continues and the fight has not ended. It is necessary to stay alert and to avoid a potentially paralyzing self-complacency. This collection focusses on topics that are particularly relevant for the present era. It examines issues such as multiculturalism, globalization, international criminal justice (specifically third and fourth generation rights) and, within this thematic framework, the problems that have come about as a result of the expanding reach of the Internet and of new biomedical advances. In addition, it explores the increasingly urgent challenge of how to respond to international terrorism, in view of worldwide events since September 11, 2001, and its resulting aftermath. Originally published in Spanish, this thought-provoking collection will be of interest to human rights scholars and practitioners alike.
