Workers' Rights as Human Rights pdf/epub/kindle/txt ebooks
By:James A. Gross
Published on 2006-01-01 by Cornell University Press

Download

Until recently, the international human rights movement and nongovernmental organizations, human rights scholars, and even labor organizations and advocates have given little attention to worker rights as human rights. James A. Gross finds, however, that employers, not just governments, have the power to violate workers' rights. Workers' Rights as Human Rights provides a new perspective on the assessment of U.S. labor relations law by using human rights principles as standards for judgment. The authors also present innovative recommendations for what should and can be done to bring U.S. labor law into conformity with international human rights standards. This volume constitutes a long overdue beginning toward the promotion and protection of worker rights as human rights in the United States.

The prevention of violations of human rights must become the dominant protection strategy of the twenty-first century, nationally, regionally, and globally. This book clearly identifies the need for preventive human rights strategies, maps what exists by way of such strategies at the present time, and offers policy options to deal with the world of the future. Written by a former UN High Commissioner for Human Rights, the book suggests the future lies in strong national protection systems backed up by regional and international organs and an international criminal justice system. The book explores the future of preventive human rights through a wide range of contemporary issues, including: climate change pandemics mass migration global poverty and pervasive inequality inter-state conflicts terrorism, including WMD terrorism gross violations of human rights the financial and economic crisis ãee We are already in a quite different world in the 21st century, and human rights thinking will need to evolve to meet its needs. On Human Rights pdf/epub/kindle/txt ebooks

What is a human right? How can we tell whether a proposed human right really is one? How do we establish the content of particular human rights, and how do we resolve conflicts between them? These are pressing questions for philosophers, political theorists, jurisprudents, international lawyers, and activists. James Griffin offers answers in his compelling new investigation of the foundations of human rights. First, On Human Rights traces the idea of a natural right from its origin in the late Middle Ages, when the rights were seen as deriving from natural laws, through the seventeenth and eighteenth centuries, when the original theological background was progressively dropped and 'natural law' emptied of most of its original meaning. By the end of the Enlightenment, the term 'human rights' (droits de l'homme) appeared, marking the purge of the theological background. But the Enlightenment, in putting nothing in its place, left us with an unsatisfactory, incomplete idea of a human right. Griffin shows how the language of human rights has become debased. There are scarcely any accepted criteria, either in the academic or the public sphere, for correct use of the term. He takes on the task of showing the way towards a determinate concept of human rights, based on their relation to the human status that we all share. He works from certain paradigm cases, such as freedom of expression and freedom of worship, to more disputed cases such as welfare rights - for instance the idea of a human right to health. His goal is a substantive account of human rights - an account with enough content to tell us whether proposed rights really are rights. Griffin emphasizes the practical as well as theoretical urgency of this goal: as the United Nations recognized in 1948 with its Universal Declaration, the idea of human rights has considerable power to improve the lot of humanity around the world. We can't do without the idea of human rights, and we need to get clear about it. It is our job now - the job of this book - to influence and develop the unsettled discourse of human rights so as to complete the incomplete idea.

Human Rights and the Body pdf/epub/kindle/txt ebooks
By:Annabelle Mooney
Published on 2016-05-13 by Routledge

Download

Human Rights and the Body is a response to the crisis in human rights, to the very real concern that without a secure foundation for the concept of human rights, their very existence is threatened. While there has been consideration of the discourses of human rights and the way in which the body is written upon, research in linguistics has not yet been fully brought to bear on either human rights or the body. Drawing on legal concepts and aspects of the law of human rights, Mooney aims to provide a universally defensible set of human rights and a foundation, or rather a frame, for them. She argues that the proper frames for human rights are firstly the human body, seen as an index reliant on the natural world, secondly the globe and finally, language. These three frames generate rights to food, water, sleep and shelter, environmental protection and a right against dehumanization. This book is essential reading for researchers and graduate students in the fields of human rights and semiotics of law.

Not Enough pdf/epub/kindle/txt ebooks
By:Samuel Moyn
Published on 2018-04-10 by Harvard University Press

The age of human rights has been kindest to the rich. Even as state violations of political rights garnered unprecedented attention due to human rights campaigns, a commitment to material equality disappeared. In its place, market fundamentalism has emerged as the dominant force in national and global economies. In this provocative book, Samuel Moyn analyzes how and why we chose to make human rights our highest ideals while simultaneously neglecting the demands of a broader social and economic justice. In a pioneering history of rights stretching back to the Bible, Not Enough charts how twentieth-century welfare states, concerned about both abject poverty and soaring wealth, resolved to fulfill their citizens’ most basic needs without forgetting to contain how much the rich could tower over the rest. In the wake of two world wars and the collapse of empires, new states tried to take welfare beyond its original European and American homelands and went so far as to challenge inequality on a global scale. But their plans were foiled as a neoliberal faith in markets triumphed instead. Moyn places the career of the human rights movement in relation to this disturbing shift from the egalitarian politics of yesterday to the neoliberal globalization of today. Exploring why the rise of human rights has occurred alongside enduring and exploding inequality, and why activists came to seek remedies for indigence without challenging wealth, Not Enough calls for more ambitious ideals and movements to achieve a humane and equitable world.

Forty years ago the European Convention for the Protection of Human Rights & Fundamental Freedoms came into force. It was born of the shared conviction that breaches of the most elementary human rights, such as had been experienced in the 1930s & '40s, should never be allowed to occur again. The Convention & the control bodies responsible for ensuring the observance of the engagements undertaken by the contracting States have had a profound influence on democratic European society in the latter half of this century, & have had repercussions outside Europe too; indeed the European system of human rights protection has served as a model or basic reference text for other regional systems. The European System for the Protection of Human Rights is a unique collection of essays by some of the most outstanding scholars & practitioners in the field of European Human Rights. Its aim is not only to sum up forty years of European experience in the collective endeavour to protect human rights, but above all to stimulate critical thinking about that experience & to review whether the Convention sytem as it stands is still fitted to meet the needs of European society in the coming millenium.
